New Compliance Directive for Food Business Operators
The Food Safety and Standards Authority of India (FSSAI) has issued a new directive requiring all Food Business Operators (FBOs) to update their Form IX nominee details promptly whenever there is a change in the designated responsible person. The move aims to ensure regulatory compliance and keep licensing authorities informed about the latest nominee details.
Key Directives from FSSAI:
1. Mandatory Update of Form IX Nominee Details
FSSAI has observed that many FBOs fail to update the details of their Form IX nominee, who is responsible for ensuring compliance with food safety regulations. According to Rule 2.5.2 of the Food Safety and Standards Rules, 2011, any change in the nomination must be communicated to the Licensing Authority without delay.
Additionally, as per Section 2.1.9 (1) of the FSS (Licensing and Registration of Food Businesses) Regulations, 2011, FBOs must keep the licensing authority informed about:
- Changes in nominee details
- Modifications in business activities
- Alterations in product categories, layout, or expansions
Failure to comply with these regulations will result in penalties under Section 58 of the Food Safety and Standards Act, 2006.
2. Auto-Approval for Non-Form C Modifications in FoSCoS
In a significant update, FSSAI has introduced a self-modification provision for Non-Form C modifications in the Food Safety Compliance System (FoSCoS).
Effective from February 12, 2025, FBOs can modify their Form IX nominee details and other Non-Form C information in FoSCoS without requiring approval or scrutiny from the licensing authority. This change is aimed at streamlining compliance processes.
